Welcome to CrawlKit, operated by Mazlum Özhan ("Service", "Platform", "we", "us", or "our"). By accessing or using our website at https://crawlkit.sh and our web scraping API services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using CrawlKit, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, Cookie Policy, and Acceptable Use Policy, which are incorporated herein by reference.

You represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

CrawlKit provides a web scraping API platform that enables users to extract publicly available data from websites. Our Service includes:

• Web scraping API access
• Data extraction tools
• Credit-based usage system
• API documentation and support

All data collected through our Service originates from publicly accessible sources on the internet. CrawlKit does not create, edit, or maintain proprietary datasets.

3. Account Registration

To use our Service, you must create an account by providing:

• Valid email address
• Full name
• Company name (optional)

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring all information provided is accurate and up-to-date

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Free Trial and Credits

4.1 Free Trial

Upon registration, you will receive 100 free credits with no expiration date. These credits allow you to test our Service before purchasing a paid plan.

4.2 Credit System

Our Service operates on a credit-based system:

• Each API request consumes a specific number of credits based on the endpoint used
• Credit consumption rates are detailed in our documentation
• Credits are non-transferable between accounts
• Unused credits from paid plans do not roll over to subsequent billing periods unless otherwise specified in your plan

5. Payment Terms

5.1 Payment Processing

All payments are processed securely through LemonSqueezy, our authorized payment processor. By making a purchase, you agree to LemonSqueezy's terms of service and privacy policy.

5.2 Billing

• Paid subscriptions are billed on a recurring basis (monthly or annually) as selected during purchase
• The billing cycle begins on the date of your first payment
• You authorize us to charge your payment method automatically at the start of each billing period
• All prices are displayed in USD unless otherwise specified

5.3 Upgrades and Downgrades

• Upgrades: When upgrading your plan, you will be charged a prorated amount for the remainder of your current billing period. The upgrade takes effect immediately upon payment.
• Downgrades: When downgrading, the change takes effect at the start of your next billing period. No prorated refunds will be issued for the current period.

5.4 Price Changes

We reserve the right to modify our pricing at any time. Price changes will be communicated at least 30 days in advance and will apply to your next billing cycle.

6. Refund Policy

We offer refunds under the following conditions:

• Eligibility: Refund requests must be submitted within 14 days of purchase
• Usage Requirement: Credits must be less than 1% used at the time of the refund request
• Partial Refunds: We do not offer partial refunds for partially used credits
• Process: To request a refund, contact us at support@crawlkit.sh with your account email and order details

Refunds will be processed to the original payment method within 5-10 business days.

Non-refundable situations:

• Credits used beyond the 1% threshold
• Accounts terminated for Terms violations
• Requests made after the 14-day window

7. License and Data Usage

7.1 License Grant

While your subscription is active, CrawlKit grants you a non-exclusive, worldwide license to:

• Access and use the API
• Store, display, and analyze data retrieved through the API
• Redistribute data commercially or non-commercially

7.2 Data Ownership

• All data retrieved through CrawlKit originates from publicly available sources
• CrawlKit does not claim ownership of the data you collect
• You are solely responsible for ensuring your use of collected data complies with applicable laws and the terms of the source websites

7.3 License Termination

Your license to receive new data terminates when your subscription ends. Previously retrieved data remains yours, but you are responsible for its accuracy and legal use.

8. Acceptable Use

Your use of CrawlKit is subject to our Acceptable Use Policy. You agree NOT to:

• Use the Service for any illegal purpose
• Scrape websites in violation of their terms of service
• Collect personal data without proper legal basis
• Overwhelm target websites with excessive requests
• Attempt to circumvent our rate limits or security measures
• Resell or redistribute CrawlKit's API access
• Use the Service to harm, harass, or infringe upon others' rights

Violation of these terms may result in immediate account termination without refund.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Data retrieved will be accurate, complete, or current
• The Service will meet your specific requirements
• Any errors will be corrected

You acknowledge that web scraping results depend on third-party websites that are beyond our control.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• CrawlKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for any damages resulting from:
  • Your use or inability to use the Service
  • Unauthorized access to your data
  • Third-party actions or content
  • Service interruptions or data loss

11. Indemnification

You agree to indemnify, defend, and hold harmless CrawlKit, its owner, affiliates, and service providers from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Data you collect or process using the Service

12. Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service at any time
• Update these Terms with reasonable notice
• Change features, functionality, or pricing

Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

• Canceling your subscription through your account dashboard

13.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if:

• You breach these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law
• We discontinue the Service

13.3 Effect of Termination

Upon termination:

• Your access to the Service will cease immediately
• Unused credits will be forfeited (unless eligible for refund under Section 6)
• Provisions that by their nature should survive will remain in effect

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.

14.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

14.3 Dispute Resolution

Before initiating legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at support@crawlkit.sh. We will attempt to resolve the dispute within 30 days.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and CrawlKit.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.

15.5 Language

These Terms are written in English. In case of any discrepancy between translated versions, the English version shall prevail.
